Nothing on this site is an offer of credit, an approval, or a commitment to lend.
The calculators do arithmetic on figures you type in. They are not quotes, appraisals, valuations or advice.
Ovesture is not a law firm, an accountancy firm or a fiduciary. Reading a page or sending a form does not make us your adviser or your lawyer.
We cannot promise any outcome — not an approval, not a rate, not a settlement, not a result with a funder.
Use the site for the purpose it exists for, and take professional advice before you sign anything.

What this site is

This website explains the funding routes we work with, sets out how they behave, and gives you a way to reach a person.

Everything published here is general information about how a type of financing works. It is not tailored to your business, because we have not seen your business. Two companies with the same revenue and the same balance can need opposite answers, and no web page can tell which one you are.

By using this website you accept these terms. If you do not accept them, the right move is to stop using the site and call us instead.

The calculators and tools

This site carries interactive tools — among them a stacked-position calculator and a debt service coverage check. Each does the same thing: it performs arithmetic on the figures you type into it, in your browser, and shows you the result.

What a result is

A result is a restatement of your own numbers. It is only as accurate as what you entered, and the tools cannot tell whether a figure is right, out of date or a guess. Each tool states its own assumptions on screen — how a daily debit is counted, what an amortisation assumes, which figure a ratio is measured against — and those assumptions change the answer.

What a result is not

Not an offer, a quote, a pre-approval or a commitment to lend by Ovesture or anyone else.
Not a valuation or an appraisal of a business, a practice or an asset.
Not legal, tax, accounting, investment or financial advice.
Not a prediction. Nothing in a tool forecasts whether a business will survive, whether a lender will approve you, or what a funder will do.
Not a substitute for your own contracts. Where a calculator and your signed agreement disagree, your agreement is what governs.

Any figure shown as an example on this site is illustrative — a demonstration of the arithmetic, not a rate we are offering and not a typical outcome. Check every result against your own statements, contracts and advisers before you act on it.

No advice, and no attorney-client relationship

Ovesture is not a law firm and does not practice law. Nothing on this site is legal advice, and no page, tool, email, form submission or phone call with us creates an attorney-client relationship. We do not represent you and we do not negotiate with a funder as your legal agent.

Please do not send us privileged or confidential material through this website. A message sent through a web form is not a privileged communication and cannot be treated as one.

We are also not your accountant, your tax adviser, your investment adviser or your fiduciary. If a lawsuit, a judgment, a UCC lien, a frozen account or an insolvency question is in play, speak to a qualified lawyer in your state first. We will say the same thing on the phone.

No guarantee of funding or outcome

Whether financing is available to you, on what terms, and how quickly, depends on facts we cannot see from a web page: your books, your credit, your existing obligations, the lender's own criteria, and rules that change without notice.

So nothing here is a promise. We do not guarantee that you will be approved, that a particular rate or term will be available, that a consolidation or a reverse consolidation will work in your situation, or that any negotiation will reach a particular result. Where we think a route is wrong for you, we will say so — including when the answer is that you should not borrow more.

We publish no success rates, no funded volumes and no approval statistics. If you find a figure like that attributed to Ovesture, it did not come from us.

What you send us

When you send a form or an email, you confirm that the information is accurate as far as you know, that you are authorized to give it on behalf of the business, and that you are contacting us about a business — this site is not for consumer debt or personal borrowing.

How we handle what you send is set out in our Privacy Policy. In short: it is used to answer you, we do not sell it, we call or text only with your permission, and we delete it on request.

Do not use this site to send anything unlawful, to impersonate somebody else, to submit another person's details without their permission, or to attack, scrape or overload the service. We may decline to respond to, and may remove, anything sent in bad faith.

Lenders, links and other people's material

We link to lenders, to the U.S. Small Business Administration, to state registries and to outside reporting. Those sites are not ours. We do not control what they publish, what they collect or what they later change, and a link is not an endorsement.

Any financing you take is a contract between you and that lender or funder, on their terms and their documents. Read them. Where our description of a program and a lender's own documentation disagree, the documentation governs — program rules, in particular SBA rules, change and a page can go out of date between one revision and the next.

Our content

The text, design, illustrations and tools on this site belong to Ovesture, except where they are credited to somebody else. You are welcome to read them, print them, and quote a short passage with attribution and a link.

Republishing a page wholesale, or using this material to build a competing service, is not permitted without our written agreement.

Liability

This website is provided as it is. We take real care with what we publish and we correct mistakes when we find them, but we do not warrant that every page is complete, current or free of error, or that the site is always available.

To the fullest extent the law allows, Ovesture is not liable for indirect, incidental, special or consequential loss arising from your use of this website or of a figure produced by one of its tools — including lost profits, lost funding or business interruption. Our total liability for anything connected with this website is limited to one hundred US dollars (US$100).

None of this limits liability that cannot be limited by law, including liability for fraud. Nothing in these terms affects the separate agreement you would sign with us or with a lender if a funding transaction goes ahead — that agreement stands on its own terms.

Changes

We may update these terms as the site changes. The version on this page, with the date at the top, is the one that applies. Continuing to use the site after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising from this website will be brought in the state or federal courts sitting in New York County, New York, and you and we each agree to that venue.

If any part of these terms is found unenforceable, the rest continues to apply.
